1.Acceptance of Terms

By downloading, installing, or using FolderCascade ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not download, install, or use the App.

2.License Grant

Subject to your compliance with these Terms, FolderCascade grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on macOS devices that you own or control, solely for your personal, non-commercial purposes, and subject to the terms and conditions of the Apple Media Services Terms and Conditions.

3.Description of the App

FolderCascade is a macOS application designed to apply Finder color labels to folder hierarchies. The App modifies only Finder label metadata and does not alter your files or folder contents. The App operates entirely offline on your local device.

4.User Responsibilities

You are responsible for ensuring you have appropriate permissions to modify folder metadata on your system. You agree not to use the App for any unlawful purpose or in any way that could damage, disable, or impair the App or interfere with any other party's use of the App.

5.Intellectual Property

The App, including its design, features, and content, is owned by FolderCascade and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code of the App.

6.Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOLDERCASCADE OR ITS DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

8.Indemnification

You agree to indemnify, defend, and hold harmless FolderCascade and its developers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or your violation of these Terms.

9.Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

10.Changes to Terms

We reserve the right to modify these Terms of Use at any time. Any changes will be effective immediately upon posting the revised Terms. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

11.Governing Law

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions.
